Terms of service

Tickets are issued subject to the following terms and conditions. By purchasing the tickets, passengers acknowledge and confirm that they have read, understood and accepted the terms and conditions.

1. Exclusion of Liability

All persons entering and boarding a Bridge Cross Investments cc vehicle and/or property
owned by Bridge Cross Investments cc or under its control do so entirely AT THEIR OWN RISK.

Bridge Cross Investments cc is not liable for any loss or damage (including consequential Or special damages or loss of profit), loss of life, bodily injury or damage to or loss of property of whatsoever nature however so caused, and whether or not caused by Bridge Cross Investments cc, its directors, its officers, servants, agents, or any other person acting on behalf of or under the control of Bridge Cross Investments cc, arising out of connected in any way with the transportation or non-transportation by Bridge Cross Investments cc of any passenger or persons and/ or their property.

2. Tickets

● Tickets are not transferable and are valid for use only by the persons to whom they are issued
and for the date and time shown thereon.

● It is the passengers’ responsibility to ensure that the correct information is shown on the ticket.

● Any alteration to a ticket will render it invalid. Any change of trip requires the issue of a replacement ticket.

● Positive identification may be requested when boarding the coach.

● Only tickets’ purchased from Bridge Cross Investments cc or its appointed agents will be valid. Any ticket/s obtained from any other source other than an appointed agency will be void and the bearer of such ticket/s shall have no claim whatsoever against Bridge Cross Investments cc, its directors, its staff, its representatives or any other person acting on behalf of or under the instruction of Bridge Cross Investments cc, for any damages whatsoever.

3. Ticket Cancellation & Reschedule

A ticket may be cancelled subject to the following:

● More than 5 hours before departure, a refund or re-schedule is permitted and a NAD 50.00
admin fee applies. A 10% cancellation fee will apply to the refundable amount, which will be subject to a 48 hours window of processing.

● At or less than 5 hours to 1 hour before departure, only a re-schedule is permitted and a refund is not permitted, a Nad 50.00 admin fee applies.

● No refund or rescheduling will be permitted within 1 hour of the scheduled departure.

● With any re-scheduling, any increase in fare at the time of the re-booking being actioned will also be for the account of the Passenger. No Refunds are permitted at whatsoever time after departure of the coach. Any change to a ticket requires a new booking to be issued by Bridge Cross Investments cc and it does not guarantee the availability of a similar ticket class, fare, discount, seat or reserved seating.

● To cancel or change a ticket, please notify the nearest Bridge Cross Investmentsc coffice, or the agent where the ticket was purchased, or call our customer care lines on +264 83 724 2501-3 or whatsapp on +264 81 707 9957.

● Positive proof of identification and banking details will be required which must be sent to Bridge Cross Investments cc the cancellation is done physically or telephonically.

● Bridge Cross Investments cc will not be bound by VERBAL QUOTATIONS. Quotes are valid ONLY at the time the quotation is provided in writing unless expressly indicated otherwise.

4. Timetables & Schedule

● Passengers are requested to be at the applicable terminal or pick-up point 30 MINUTES
before departure. Should a passenger be late for the scheduled departure time, a new ticket will have to be purchased.

● Reservations / booked seats that are not filled/occupied 5 MINUTES before departure will be offered to stand-by passengers on a first come first serve basis.

● Whilst Bridge Cross Investments cc will make all reasonable efforts to keep to its scheduled timetables, Bridge Cross Investments cc and its sub-contractors DOES NOT guarantee any arrival or departure times, and it does NOT accept any liability for any loss including consequential loss or damage incurred by any passenger, or inconvenience experienced by any person, due to a delay or cancellation of any service for whatsoever reason.

● Bridge Cross Investments cc reserves the right to cancel any of its services for any reason WITHOUT prior notice. Bridge Cross Investments cc is NOT liable for any loss, consequential or otherwise, or damage incurred by passengers because of such cancellation.

● All passengers must exit the bus upon request by the driver, other bus crew members, or any member of law enforcement.

● During a stop, the driver, electronic system, or any other bus crew member may announce to the passengers a firm time of departure when the bus will leave that location or how much time the break will take to resume the bus trip. It is the sole responsibility of every passenger to be onboard the bus at or before the departure time. It is the sole responsibility of any parent, legal guardian, or other passenger who is traveling with children to ensure that all children traveling are also on board at the announced departure time or after the announced break duration time. Any passengers who are not back onboard the bus by the announced departure time may be left behind. The driver has no duty to wait for any late or absent passengers to return to the bus. Should any passengers fail to be back onboard the bus by the announced departure time or break duration time and are left behind at the location of the stop, Bridge Cross Investments cc and Bus Operators shall not be held responsible or liable. Any such passengers are not entitled to any refund, compensation, or substitute or return transportation of any kind.

● During a stop, it is the passenger’s sole responsibility to remove any valuables from the bus to prevent loss, theft, or damage, for which Bridge Cross Investments cc shall not be held responsible or liable.

5. Right of Admission

● Bridge Cross Investments cc reserves the right of admission to any of its coaches. Upon the exercising of such discretion with reference to a bona fide ticket holder by Bridge Cross Investments cc as and when it may deem necessary, such a ticket holder would be reimbursed in full.

6. Breakdowns, Delays and Cancellation of Service

NO REFUNDS will be paid in the event of a breakdown or a delay.

● In the event of a breakdown or delay Bridge Cross Investments cc WILL NOT be held liable for connecting services, scheduled meetings, free refreshments, accommodation or any form of transportation or compensation.

● Services may be cancelled due to adverse operational conditions including but not limited to force majeure, man-made impediments including strike action or mass looting, etc.

● NO REFUNDS will be issued if a service is cancelled due to weather or any adverse conditions that are beyond Bridge Cross Investments cc’s control. All passengers will be rebooked for an alternative date and time as per the passenger’s request.

● Bridge Cross Investments cc reserves the right to shuttle passengers between stops.

7. Fares & Pricing

● All fares are subject to change without prior notice. Bridge Cross Investments cc will only be
bound by the fare charged upon the purchase of ticket.

8. Smoking Drugs & Alcohol

● Bridge Cross Investments cc reserves the right to refuse to undertake the conveyance of any passenger/s found to be intoxicated, using/carrying illicit drugs or smoking on board. This includes the use of all smokeless tobacco products including e-cigarettes. Any passenger may be denied boarding should they be deemed as intoxicated or inebriated.

● Any person found in breach of Bridge Cross Investments cc’s terms and conditions regarding the consumption of alcohol, use of drugs or smoking will be DISEMBARKED immediately at the NEXT POSSIBLE STOP and no compensation, refund or rescheduling of service requests will be made. In addition, should the need arise, legal action may be initiated against the perpetrator that is found in breach of this or any other specified terms and conditions of carriage.

9. Children, Pets & Medical Conditions

● No children under the age of 13 years will be conveyed without being accompanied by an
adult.

● Children younger than 5 years travel for free if not occupying a seat.

● Should more than one child under 5 years old accompany the same adult, all such additional children are required to purchase tickets at the applicable rate.

● No animals will be carried on board any of Bridge Cross Investments cc’s coaches under any circumstance whatsoever.

● Passengers with special needs, including passengers with medical conditions and disabilities, are required to inform Bridge Cross Investments cc before they travel with Bridge Cross Investments cc’s coaches.

● Passengers with any medical condition, whether chronic or not, are advised to consult a medical practitioner prior to departure. Bridge Cross Investments cc reserves the right to request medical clearance certificates where it may deem necessary to allow boarding access to passengers with medical conditions.

10. Passenger’s Luggage

● Any luggage ferried will be at the owner's risk. Bridge Cross Investments cc does expressly disclaim liability for any lost or damaged baggage and for any injuries caused by or resulting from shifting baggage. Passengers must stow and transfer their own baggage and must keep any carry-on baggage, including any personal belongings, in their possession always. Bridge Cross Investments does not check bags and does not assume any responsibility for the safe and secure transport of bags over any bus routes, including transfers. Baggage must comply with baggage allowances and restrictions as stated in these Terms.

● Passengers wishing to stow baggage in the under-bus baggage compartment do so at their own risk. Passengers are responsible for picking up their baggage promptly upon arrival and for transferring their baggage from one bus to another during a transfer. Storage charges may apply for any baggage/items left behind. Passengers requiring special assistance with baggage must speak with Bus Operator personnel to make necessary arrangements.

● All passengers are advised to clearly label all baggage with their name, address, and telephone number.

● All bags are subject to search, including at terminals and on buses.

● A maximum of 2 x pieces of regular baggage (suitcase for clothing) not exceeding 25kg in total will be permitted per ticket holder. Excess baggage/luggage fees will be charged for baggage/luggage in excess of this provision at the time of reservation or boarding/check-in by luggage attendants on duty.

● Passengers are solely responsible for carry-on baggage during the entire trip and Bridge Cross Investments cc and Bus Operators shall not be liable for any missing or damaged carry-on baggage. Passengers are required to stow and monitor their carry-on baggage in a manner that ensures that: (i) the safety and proper operation of the bus is not compromised, and (ii) does not inconvenience other passengers. Carry-on baggage should be, whenever possible, stowed in the overhead compartments or placed under the seats directly in front of the passenger.

● Carry-on baggage and its contents shall remain in the care of passengers for the duration of the trip and must be monitored appropriately. If any unauthorized access by third parties is observed, the bus driver or any of the crew members should be informed. Passengers are responsible for checking carry-on baggage prior to the end of their trip to ensure that nothing is missing.

5. Refunds

● Bridge Cross Investments cc expressly disclaims liability for any lost or damaged baggage, including strollers and bicycles, and for any injuries caused by or resulting from baggage.

● Passengers are solely responsible for retrieving all baggage and bicycles, including any baggage or bicycles stored under the bus. Bridge Cross Investments cc expressly disclaims any damage or loss which results from a passenger’s failure to timely retrieve his/her baggage.

● Bridge Cross Investments cc will not transport the following: weapons, rearms and ammunition (unless arranged and agreed to in writing by Bridge Cross Investments cc), or any explosives, reworks, any illegal items including drugs, substances used to manufacture narcotics and illegal cigarettes, hazardous materials including acids, batteries containing liquid acid, gases in cylinders/ empty gas cylinders, flammable, corrosive or caustic materials or products, poisons and radioactive materials or products, live animals, abattoir products, corpses, assembled coffins, perishable goods including, but not limited to meat, fish, any other food or perishable food products (save for food and beverages taken on-board for consumption whilst travelling), dry ice, used fuel tanks, paint.

● Bridge Cross Investments cc may in its sole discretion and without the giving of any reason, refuse the transport of any goods and no liability shall be attracted by such refusal.

● In the event that Bridge Cross Investments cc is held to be liable for any loss, damage, death or injury by any court with competent jurisdiction, all and any direct, indirect and consequential damages shall in total be limited to an amount not exceeding NAD 7,500 (Seven Thousand and Five Hundred NAD) for cross-border travellers, notwithstanding the nominated foreign currency, and the amount of NAD5000 (Five Thousand NAD) for travelling within the Republic of Namibia. In respect of cross-border travellers, the relevant exchange rate shall be the applicable rate prevailing on the date of actual payment.

11. Travel Documentation

● Passports are compulsory on all cross-border routes and remain the sole responsibility of the passenger. Bridge Cross Investments cc accepts no responsibility for passengers who are not in possession of proper and valid travel documents, or where entry to any country or territory is refused to any person for any reason.

● No passenger shall have any claim of any nature against Bridge Cross Investments cc or its appointed agents, should he/she be prevented from undertaking or continuing with any journey as a result of the failure to produce any official documents, including travelling documents to any authority.

● Visitors to any of the SADC countries served by Bridge Cross Investments cc including, but not limited to, Botswana, Malawi, Mozambique, Namibia, South Africa, Zambia or Zimbabwe are to ensure they comply with the various health regulations of each destination country and are reminded that these countries may have malaria, or any other conditions that may entail medical risk and may by law or otherwise require certain inoculations, vaccinations, x-ray’s or any other medical precautionary measures to be taken and are advised to consult with a travelling clinic or medical practitioner prior to departing on a cross border trip.

● Passengers travelling cross border must take note that certain borders require the production of monetary amounts or bank statements for three months or additional periods, money or requirements to prove their financial means before being allowed to cross the border.

● Passengers are advised to contact the relevant immigration authorities and to familiarise themselves of all cross-border requirements. Bridge Cross Investments cc does not accept liability in the event any passenger is refused passage by any border control/immigration or other governmental officials.

● Passengers found in breach of any of the aforementioned terms related to cross-border travel, or with incorrect or incomplete official or other travel documents, proof of monetary means, medical requirement or any other official requirements for cross-border travel, may not be allowed to travel or to continue with their journey, and Bridge Cross Investments cc will have no liability whatsoever to transport them to any destination and passengers shall be liable for their own transport and accommodation arrangements, and no claim shall arise against Bridge Cross Investments cc.

● By accepting the ticket the passenger is accepting these Terms and Conditions, and the passenger makes the following declaration: I am fully aware of the legal, monetary and medical requirements and the aforementioned terms related to local and cross-border travel, and I accept my responsibilities in terms thereof.

● Insofar as I intend travelling across the borders I further declare that all travelling and official documents required for myself and any minor child travelling with me are valid and that my passport as well as the passport of any minor child travelling with me has more than 30 (thirty) days before expiry. I furthermore indemnify Bridge Cross Investments cc of any liability towards me or any claim that may arise as a result of my failure in ensuring all travel and official documents are sufficient and valid, or my failure to provide money, or proof of monetary means to any value that may be required by cross-border officials, or any medical precautions as may be required or any other official requirements for cross-border or local travel.

12. On Board Entertainment

● Bridge Cross Investments cc broadcast family-friendly video and audio material on all coaches where possible and do not promise the availability of onboard material or entertainment on any coach.

13. Insurance

● Bridge Cross Investments cc does not offer general insurance coverage for its passengers,
their property or their luggage. It is the responsibility of the passenger to ensure that he/she is adequately insured.

14. General

● Bridge Cross Investments cc DOES NOT provide specific seating or guarantee sitting
together in a case of more than one passenger. The right of admission is reserved.

● Bridge Cross Investments cc reserves the right to revise seat allocations WITHOUT PRIOR notice and to operate substitute vehicles of a different standard from those advertised should operational requirements or circumstances dictate.

● Should you have a complaint concerning Bridge Cross Investments cc, you should inform Bridge Cross Investments cc as soon as possible within 3 days of the incident. Bridge Cross Investments cc will not consider any complaints after 3 days. Any complaints should be emailed to oasissupportteam@bridgecrossnam.com

● Bridge Cross Investments cc reserves the right to inspect the ticket, travel documents, luggage, goods, packages and parcels of any passenger. Bridge Cross Investments cc reserves the right to refuse to transport or continue to transport, any passenger/s or their luggage or goods for a bona fide reason.

● Reservations, purchases, and seating is without regard to race, colour, creed, national origin or any other protected characteristic. We want to make sure all our customers have proper access to Bridge Cross Investments cc’s services, information, and benefits. So, if a passengers English is limited, Bridge cross invetsments cc will do everything we can to help you when you ride with us or use our facilities.

● Passengers who engage in any Prohibited Conduct shall be liable for any result direct or indirect harm and/or damage caused to himself/herself, the driver, the bus crew, or other passengers or to Bridge Cross Investments cc’s bus and/or property, or the property of other passengers.

● The terms and conditions as detailed in the conditions of carriage shall be severable of each other. Should any of these terms and conditions be found to be invalid, the said term or condition shall not affect the validity of the remaining or any other terms and conditions of carriage.
